Terms & Conditions

Effective date: 20 November 2025
Entity: Amplify RSA (“Amplify”, “we”, “us”, “our”).
Scope: These Terms govern (a) use of our website and online services, and (b) participation in the Amplify Interschool Music Tournament (the “Event”). By using the site or submitting an entry, you agree to these Terms.

Terms & Conditions - the basics

1) Key Definitions

“Learner”: a participant (typically a minor) entered by a school.

“School”: a South African public or independent secondary school entering learners.

“Responsible adult”: teacher/coach/guardian overseeing learners.

“Operator/Service Provider”: third parties we use for hosting, ticketing, payments, analytics, media, etc. (ECTA supplier-info and POPIA operator duties apply.)

2) Who May Enter (Eligibility)

Open to Grades 8–12 learners enrolled at South African schools.

Combined (“multi-school”) acts require prior written approval.

Schools may enter multiple categories if the schedule allows.

We may request proof of enrolment/age at accreditation.

3) Divisions & Set Lengths (Summary)

Contemporary Band (8–12 min), Original Music (8–12 min), Jazz Ensemble (8–10 min), Choir & A Cappella (5–7 min).

Production points are available only for acts using their own supervised student tech crew; house-crewed acts are not scored on production.

4) Entries, Fees, and Quotas

A per-student registration fee covers accreditation, event shirt, lanyard, administration and insurance share.

Division quotas apply; once full, a timestamped waitlist may operate.

A completed entry is only accepted once payment and required documentation (stage plot, tech rider, set list) are received by the stated deadlines.

We comply with the CPA’s provisions on advance bookings and reasonable cancellation charges.

5) Cancellations & Refunds

Our refund schedule and deadlines are published in the Competitor Handbook (admin cut-offs; no-show policy).

If the Event is substantially changed, postponed or cancelled due to circumstances beyond our control (see Force Majeure), we will communicate available remedies (reschedule, partial refund, or credit) as required by South African consumer law.

6) Direct Marketing & Cooling-Off

If we conclude a contract as a result of direct marketing, consumers have a 5-business-day cooling-off right to cancel, as provided by CPA s16 (where ECTA cooling-off does not already apply).

7) Online Disclosures (ECTA s43)

When we sell services online (e.g., registration, tickets), we will clearly display supplier details, contact information, total price, terms of payment, and the steps to complete/correct an order, in line with ECTA s43.

8) Repertoire, Licensing & Set Lists

Covers and originals are welcome.

Amplify obtains a SAMRO public-performance licence; schools must submit accurate set lists (titles/composers/arrangers) for royalty reporting. Original works remain the creators’ property.

9) Privacy, Children’s Information & Media

We process personal information per our Privacy Policy and POPIA.

Because learners are minors, schools must secure opt-in parental/guardian consent for images and personal info used for event communications, following Information Regulator guidance on children’s information. 
 

Some Operators may store/process data outside SA; we use appropriate safeguards under POPIA s72 (cross-border transfers).

10) Website Use & Content

Site content is provided “as is” for general information and may change without notice.

Intellectual Property: All trademarks, logos, graphics, copy, photos and videos on the site are owned by Amplify or licensed to us. You may not reproduce or exploit them without permission.

User content: If you submit materials (e.g., testimonials, photos with consent), you grant us a non-exclusive, royalty-free licence to use them in connection with the Event (you retain ownership of your content).

11) Third-Party Platforms

Ticketing/payment gateways, mapping, analytics, streaming, and university/venue sites are third-party services with their own terms/privacy policies. We are not responsible for their practices.

Where applicable, your use of those services is subject to their agreements.

12) Event Changes

We may modify schedules, adjudicators, venues, production specs, or formats where reasonably necessary (e.g., availability, regulatory requirements, safety, weather).

We will notify registered schools of significant changes via email and publish updates on our website/Competitor Handbook.

13) Conduct & Content Rules (Competition-Facing)

School Codes of Conduct apply.

Family-appropriate content only (no profanity, hate speech, or discriminatory content).

Props/costumes must be safe and quick to set/strike; no confetti, powders, liquids or open flame on/near equipment.

14) Force Majeure

We are not liable for non-performance caused by events beyond reasonable control, including but not limited to severe weather, venue failure, Acts of God, public utility failure, strikes, epidemics, or government action. In such cases, we may postpone, adjust, or cancel parts of the Event and will implement fair remedies consistent with the CPA.

15) Disclaimers & Liability (Website & Event)

Nothing in these Terms limits or excludes liability where such limitation/exclusion is not permitted by law (including the CPA).

Subject to the preceding sentence, we exclude indirect or consequential losses arising from use of the site or Event changes.

You remain responsible for your own devices, data connectivity, and for ensuring that entries, payments and documents are correctly submitted by deadlines.

16) Complaints & Consumer Queries

If you have a complaint, please contact us first at hello@amplifysa.co.za. If we cannot resolve it, you may have rights to escalate under South African law (e.g., National Consumer Commission) or seek other remedies available to you.

17) Access to Information (PAIA)

As a private body, we maintain a section 51 PAIA Manual explaining how to request access to records. Our PAIA Manual (and Information Officer contact details) is available on request or via our website.

18) Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Disputes may be brought in a competent South African court. If a clause is held unlawful or unenforceable, the remaining clauses continue in effect.

19) Changes to These Terms

We may update these Terms periodically. Material changes will be posted with a new effective date and, where appropriate, emailed to registered schools.
